Welcome to Real AR. These Terms and Conditions (“Terms”) govern your access to and use of the Real AR website, web-based AR scanner, applications, APIs, software, and related services (collectively, the “Service”). By accessing, registering for, or using the Service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

If you do not agree with any part of these Terms, you must not access or use the Service.

1. Definitions

For the purposes of these Terms:

“Company,” “We,” “Us,” or “Our” refers to Real AR.

“User,” “You,” or “Your” refers to any individual or legal entity accessing or using the Service.

“Content” means any data, images, videos, audio, text, graphics, files, or other materials uploaded, stored, processed, or displayed through the Service.

“AR Experience” means any augmented reality content, target, overlay, or interaction created using the Service.

“Subscription” means any paid plan, license, or recurring billing arrangement offered by Real AR.

“Third-Party Services” means any external services, platforms, APIs, or tools not owned or controlled by Real AR.

2. Scope of Services

Real AR provides a cloud-based augmented reality platform that allows users to:

• Upload images, videos, and digital assets
• Create and manage AR targets and experiences
• Scan AR content using web-based or supported devices
• Host and stream AR assets
• Access dashboards, analytics, and reporting tools
• Integrate AR experiences into marketing, education, or commercial use cases

The Service is provided for commercial and non-commercial use, subject to these Terms.

We reserve the right to update, enhance, restrict, suspend, or discontinue any aspect of the Service at our sole discretion, with or without prior notice.

3. Eligibility and Legal Capacity

3.1 Age Requirement

You must be at least 18 years of age to use the Service. By using the Service, you represent that you meet this requirement.

3.2 Authority to Bind

If you are using the Service on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms.

4. User Accounts and Responsibilities

4.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate, complete, and up-to-date information
• Not impersonate another person or entity
• Maintain only one account unless expressly permitted

4.2 Account Use

You are solely responsible for all activities conducted through your account, whether authorized by you or not.

4.3 Account Security

You are responsible for safeguarding your password and credentials. Real AR will not be liable for any loss, damage, or unauthorized activity resulting from your failure to maintain account security.

5. User Content

5.1 Ownership of Content

You retain full ownership of your Content. Real AR does not claim ownership over any Content you upload.

5.2 Content Responsibility

You represent and warrant that:

• You own or have legal rights to use and upload the Content
• The Content complies with all applicable laws and regulations
• The Content does not infringe third-party intellectual property or privacy rights

You acknowledge that Real AR is not responsible for reviewing or validating User Content.

5.3 License Grant

By uploading Content, you grant Real AR a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, host, store, cache, reproduce, modify, display, and distribute such Content solely for operating, maintaining, improving, and promoting the Service.

6. Prohibited Content and Acceptable Use

You agree not to use the Service to:

• Upload illegal, fraudulent, or deceptive content
• Upload obscene, pornographic, abusive, or defamatory material
• Promote hate speech, violence, or discrimination
• Violate data protection or privacy laws
• Upload malicious code, malware, or exploits
• Reverse engineer, scrape, or attack the Service
• Interfere with system performance or security

Violation of this section may result in immediate suspension or termination without notice.

7. Subscriptions, Pricing, and Payments

7.1 Paid Services

Some features require a paid Subscription. Subscription details, limits, and pricing are displayed on the Real AR website.

7.2 Billing Cycle

Subscriptions are billed in advance on a recurring basis (monthly, quarterly, or annually). By subscribing, you authorize Real AR to charge your payment method automatically.

7.3 Auto-Renewal

Subscriptions automatically renew unless canceled before the end of the current billing period.

7.4 Refund Policy

Payments are non-refundable, except where required by applicable law. No refunds will be issued for unused time, downgrades, or early termination.

7.5 Payment Failures

Failure to complete payment may result in suspension or downgrade of your account.

8. Data Storage and Availability

Real AR may impose limits on storage, bandwidth, or usage based on your plan. We are not responsible for loss of Content due to exceeding limits, technical failures, or account termination.

Users are responsible for maintaining backups of their Content.

9. Intellectual Property Rights

All rights, title, and interest in the Service—including software, algorithms, UI/UX, branding, logos, trademarks, and proprietary technology—remain the exclusive property of Real AR.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

10. Third-Party Services

The Service may integrate with or link to Third-Party Services. Real AR does not control and is not responsible for:

• Third-party content
• Data handling practices
• Availability or accuracy

Your use of Third-Party Services is governed by their respective terms.

11. Suspension and Termination

We may suspend or terminate your account if:

• You violate these Terms
• You misuse the Service
• Required by law or court order
• Your account remains inactive for an extended period

Upon termination, access to the Service will cease, and Content may be permanently deleted.

12. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE”. Real AR disclaims all warranties, whether express or implied, including:

• Fitness for a particular purpose
• Accuracy or reliability
• Non-infringement
• Continuous availability

Use of AR experiences is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, Real AR shall not be liable for:

• Loss of profits or revenue
• Loss of data or Content
• Business interruption
• Indirect or consequential damages

Total liability shall not exceed the amount paid by you to Real AR in the previous 12 months.

14. Indemnification

You agree to defend, indemnify, and hold harmless Real AR from any claims, damages, liabilities, and expenses arising from:

• Your use of the Service
• Your Content
• Violation of these Terms
• Violation of any law or third-party rights

15. Force Majeure

Real AR shall not be liable for failure or delay caused by events beyond reasonable control, including natural disasters, internet failures, government actions, or labor disputes.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on the website. Continued use of the Service constitutes acceptance of the revised Terms.

17. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India. Courts located in Chennai, Tamil Nadu shall have exclusive jurisdiction.
